LLC d/b/a ImagineCDs.com ("MMP") or other entities identified on
the CD ("Vendors"). The CD is licensed (not sold) to you, and
MMP or Vendors own all copyright, trade secret, patent and other
proprietary rights in the CD. MMP hereby gives you permission to
display (but not copy, transfer, distribute, or reproduce) the
contents of the CD (only in its original form as provided by MMP)
to other persons subject to the terms herein, provided that in
all such cases you may not charge or receive money or other
consideration from any person or entity for the display of the
CD or any material contained in the CD. Except as may be
permitted by applicable law, you may not decompile, reverse
engineer, disassemble or otherwise reduce the CD or its
components to a human-perceivable form. You may not rent,
modify, add or delete components or files, or create derivative
works based upon the CD in whole or in part.
You expressly
acknowledge and agree that use of the CD is at your sole risk.
The CD and any related information, documentation or materials
are provided "AS IS" and without warranty of any kind. MMP
EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED,
INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND
NONINFRINGEMENT. MMP DOES NOT WARRANT THAT THE FUNCTIONS OR
INFORMATION CONTAINED IN THE CD WILL MEET YOUR REQUIREMENTS, OR
THAT THE OPERATION OF THE CD WILL BE UNINTERRUPTED OR
ERROR-FREE, OR THAT DEFECTS IN THE CD WILL BE CORRECTED. THE
ENTIRE RISK AS TO THE INFORMATION PROVIDED ON THE CD AND THE
RESULTS AND PERFORMANCE OF THE CD IS ASSUMED BY YOU. SOME
JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES,
SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

CIRCUMSTANCES INCLUDING NEGLIGENCE, SHALL MMP, OR ITS DIRECTORS,
OFFICERS, EMPLOYEES OR AGENTS, BE LIABLE TO YOU FOR ANY ACTUAL,
INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES
(INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS
INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE)
ARISING OUT OF THE USE OF THE CD (INCLUDING INFORMATION OR
MATERIALS PROVIDED BY VENDORS OR OTHER ENTITIES ON THE CD), EVEN
IF MMP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME
JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF
LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE
LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
